Terms and conditions

Amy Macdonald Competition

1. The competition will be hosted on www.amymacdonald.co.uk

2. Closing date for entries is Sunday 18th July 2010 at 6pm GMT (“the Deadline”).

3. The competition is not open to employees of Mercury Records Limited (“Mercury”), a division of Universal Music Operations Limited (“UMO”) and their associated, affiliated or subsidiary companies, and their families, agents, or anyone connected with this competition.

4. No purchase is necessary but entrants should be aware that they may be subject to local call charges depending on their own individual arrangements for Internet access. Postal entries can be made by writing to: Amy Macdonald competition, Mercury Music Group, 364-366 Kensington High Street, London W14 8NS6. An eligible entrant must be an individual resident in Europe and must submit by including their e-mail address. Entries may be rejected at the sole discretion of Mercury and/or UMO.

5. UMO will not be liable for any failure of receipt of entries. UMO takes no responsibility for any entries that are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid. Further, UMO will not be liable for technical, hardware, or software failures of any kind or lost or unavailable network connections which may limit or prohibit an eligible entrant's ability to participate in the competition.

6. By entering the competition with a photograph submission you grant Mercury and/or UMO permission to reproduce your photograph for use in a poster comprised of fans’ photographs which can be sold and/or distributed with or within a physical CD or digital bundle product. You agree that no fee or royalty will be payable to you in connection with our use of your image, and that you have obtained agreement to these terms from all individuals who appear in your photo.

7. Photographs submitted must not infringe any rights held by third parties including but not limited to copyright and/or intellectual property rights.

8. The 1st prize is a personalised engraved iPad (64GB Wi-Fi + 3G -approximate value £700 – simcard not included) with 10 runners up prizes, being a vinyl copy of the album “A Curious Thing” signed by Amy Macdonald (each with an approximate value of £15).

9. Winners under the age of 18 must ensure that their legal guardian has read these terms and is in agreement with all grants and waivers of rights included in this document.

10. UMO reserves the right, with or without cause, to exclude entrants and withhold prizes for violating any of these General Rules and the Terms and Conditions and Terms of Use. UMO reserves the right to amend these General Rules. Any amendments will be communicated to entrants via email.

11. Winners will be notified after the Deadline that they have won.

12. The judges’ decision is final and binding on the entrants. No correspondence will be entered into.

13. There is no cash or other alternative to the prizes stated and the prizes are not transferable and no part or parts of the prize may be substituted for other benefits, items or additions.

14. Uses of personal data received by UMO and/or Mercury in the course of the competition are subject to the privacy policy found at http://www.umusic.co.uk/privacy.html.

15. By entering the competition all entrants are deemed to have accepted and be bound by these General Rules.

16. UMO reserves the right at any time to cancel, modify or supersede the competition (including altering prizes) if, in our sole discretion, a competition is not capable of being conducted as specified.

17. Nothing in these terms and conditions shall limit UMO’s liability for death or personal injury caused by their employees or agents’ negligence or for fraud.

10. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.

19. These terms and conditions shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction.

20. The promoter of this competition is Universal Music Operations Limited, a company registered in England and Wales with number 0950138 whose registered office is at 364-366 Kensington High Street, London W14 8NS.
